1. Agreement to Terms

By booking a treatment session at orisunca or using our website, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and orisunca. If you do not agree with any part of these terms, you should not use our services.

You must be at least 18 years of age to book and receive services independently. Minors under 18 may receive services only with written parental or guardian consent.

2. Definitions

For the purposes of these Terms and Conditions:

  • "We," "Us," "Our" refers to orisunca, located at Wenhua Road, No. 276, Hsinchu 300, Taiwan
  • "You," "Your," "Client" refers to the individual booking or receiving services
  • "Services" refers to Thai massage treatments offered by orisunca
  • "Practitioner" refers to trained massage therapists employed by orisunca
  • "Website" refers to our online presence and booking system

3. Service Description

orisunca provides traditional Thai massage treatments, including:

  • Deep Tissue Restoration (60-90 minutes)
  • Facial Acupressure and Head Treatment (30-45 minutes)
  • Foot and Lower Leg Restoration (45-60 minutes)

Services are subject to availability and may be modified or discontinued at our discretion. We reserve the right to refuse service to anyone for any lawful reason.

Important Notice: Our services are for relaxation and wellness purposes. They are not intended to diagnose, treat, cure, or prevent any medical condition. Thai massage is not a substitute for medical care or professional advice from a healthcare provider.

4. Booking and Appointments

4.1 Making a Booking

Appointments can be made by phone, email, or through our website booking system. A booking is confirmed only when you receive confirmation from us via email or phone.

4.2 Cancellation Policy

We require at least 24 hours notice for cancellations or rescheduling. Cancellations with less than 24 hours notice may result in a charge of 50% of the session fee. No-shows without prior notice will be charged the full session fee.

4.3 Late Arrivals

If you arrive late for your appointment, we will do our best to accommodate you. However, the session may need to be shortened to avoid delays for other clients. Late arrivals will be charged the full session fee regardless of shortened duration.

4.4 Practitioner Assignment

While we will make reasonable efforts to accommodate practitioner preferences, we cannot guarantee availability of a specific practitioner. We reserve the right to assign an alternative practitioner if necessary.

5. Payment Terms

5.1 Pricing

All prices are listed in Taiwan Dollars (TWD) and are subject to change without notice. Current pricing is available on our website and at our location. The price applicable is the price in effect at the time of booking confirmation.

5.2 Payment Methods

We accept cash and major credit cards. Payment is due at the time of service unless other arrangements have been made in advance.

5.3 Refund Policy

Services are generally non-refundable once rendered. If you are dissatisfied with your service, please speak with us immediately so we can address your concerns. Refunds are issued at our sole discretion and only in exceptional circumstances.

6. Client Responsibilities

As a client, you agree to:

6.1 Health Disclosure

Provide accurate and complete information about your health status, including any medical conditions, injuries, allergies, or medications that might affect treatment. Failure to disclose relevant health information may result in injury or complications for which we cannot be held responsible.

6.2 Communication During Session

Communicate openly with the practitioner about pressure levels, comfort, and any discomfort experienced during the session. Thai massage can be intense, and your feedback is essential for a safe and effective treatment.

6.3 Appropriate Conduct

Behave respectfully toward practitioners and staff. We maintain a zero-tolerance policy for harassment, inappropriate behavior, or requests for services beyond our professional scope. Violations will result in immediate termination of service without refund and possible legal action.

6.4 Personal Belongings

Secure your personal belongings. While we provide storage areas, we are not responsible for lost, stolen, or damaged items.

7. Practitioner Rights and Discretion

Our practitioners have the right to:

  • Decline or discontinue service if they determine it may be unsafe or inappropriate based on your health status
  • Modify techniques or pressure based on your body's response during the session
  • Request that you reschedule if you arrive for a session with a contagious illness
  • Terminate a session immediately if you behave inappropriately, with no refund provided

8. Contraindications and Warnings

Thai massage may not be appropriate for individuals with certain health conditions. You should consult your physician before booking if you have:

  • Recent surgery or acute injuries
  • Blood clotting disorders or are taking blood thinners
  • Cardiovascular conditions, uncontrolled high blood pressure, or heart disease
  • Pregnancy (especially first trimester)
  • Osteoporosis or bone fragility conditions
  • Infectious diseases or open wounds
  • Acute inflammation or fever

By booking a session, you confirm that you do not have any conditions that would make Thai massage unsafe, or that you have consulted with your physician and received clearance.

9. Limitation of Liability

To the maximum extent permitted by law:

9.1 Disclaimer of Warranties

Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific therapeutic outcomes or improvements to any medical condition.

9.2 Limitation of Damages

Our total liability to you for any claims arising from our services shall not exceed the amount you paid for the specific session giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

9.3 Exceptions

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under Taiwan law.

10. Indemnification

You agree to indemnify and hold harmless orisunca, its practitioners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms, your violation of any law or rights of a third party, or your use of our services.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for detailed information.

12. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of orisunca and is protected by Taiwan and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

13. Force Majeure

We are not liable for failure to perform our obligations if such failure is caused by circumstances beyond our reasonable control, including natural disasters, epidemics, government actions, utility failures, or other force majeure events.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Taiwan, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Hsinchu, Taiwan.

14.3 Informal Resolution

Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We commit to working with you in good faith to reach a mutually acceptable resolution.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and orisunca regarding use of our services.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

15.4 Assignment

We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.

15.5 Notice

Notices to you may be provided via email, phone, or posting on our website. You may provide notice to us at the contact information provided below.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Material changes will be communicated via email to active clients. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
